§ 359

(1) A person is authorized to apply the product legend that is set out in Schedule 9 to and use it in connection with a food commodity if (a) the food commodity is an organic product; and (b) in the case of a multi-ingredient food commodity, at least 95% of its contents are organic products.

(2) A person is authorized to advertise and sell a food commodity that has on it the product legend that is set out in Schedule 9, or a food commodity in connection with which that product legend is used, if (a) the food commodity is an organic product; and (b) in the case of a multi-ingredient food commodity, at least 95% of its contents are organic products.

(3) A person is authorized, for advertisement or information purposes, to apply the product legend that is set out in Schedule 9 to, and use it in connection with, any item to which the Act applies other than a food commodity.
