TERMS OF SERVICE

1. Acceptance

By creating a HACCPlan account or signing in, you agree to these Terms of Service ("Terms") and the Privacy Policy. If you are accepting on behalf of an organization, you confirm that you have authority to bind that organization.

2. What you can do with HACCPlan

You may use HACCPlan to record, retrieve, and report on your own food-safety production data. You may invite teammates (Operators, Managers, Viewers) to your workspace and assign them tiered permissions. You may export your data at any time in a machine-readable format.

3. What you cannot do

• Resell or rebrand HACCPlan as your own product.
• Use HACCPlan to store data unrelated to food-safety recordkeeping (e.g., as a generic file host).
• Attempt to bypass the row-level security that isolates your workspace from other tenants.
• Use the service to engage in activity that is unlawful in your jurisdiction or ours.

4. Your records are your records

You own all data you enter into HACCPlan. We have a limited licence to host, process, and display it solely to provide the service to you. We will not access your records for any purpose other than support you have requested or to comply with a lawful order.

5. Reviewer two-person rule

HACCPlan enforces a two-person review architecture at the database layer: an Operator cannot review their own batch, shipping, or monitoring record. We do this to support the intent of HACCP / SFCR / FSMA recordkeeping. You agree not to attempt to circumvent this enforcement (e.g., by sharing employee codes).

6. Service availability

We target 99.5% monthly uptime but make no formal SLA at this tier. Planned maintenance is announced via in-app banner at least 48 hours in advance. Unplanned outages are communicated as quickly as we are able.

7. Subscription + payment

Subscription fees, if any, are billed monthly in advance. If you cancel, you remain entitled to access your data through the end of the paid period and to export it at any time during or after that period.

8. Termination

You may close your account at any time from the Account page. We may suspend or terminate accounts that violate these Terms, with reasonable notice unless the violation is ongoing and harmful (in which case we may act immediately). On termination, your data is retained per the Privacy Policy's retention schedule and then deleted.

9. Limitation of liability

HACCPlan is provided "as is". To the maximum extent permitted by law, our total liability arising out of or relating to these Terms is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages.

This clause is jurisdiction-sensitive. Confirm with a lawyer that it is enforceable in your governing-law jurisdiction (e.g., Ontario, Delaware, or wherever you incorporate) before relying on it.

10. Governing law

These Terms are governed by the laws of the jurisdiction where HACCPlan is incorporated. Disputes will be resolved there. (Replace this clause with the actual jurisdiction before going live.)

11. Changes

We may update these Terms. Material changes will be posted here with at least 14 days' notice via in-app banner or email. Continued use after the effective date constitutes acceptance.
